Terms of Service

    What DesignWall is

    DesignWall operates a single public wall made of a fixed number of squares. Anyone can claim an available square, or take over an already claimed one, by placing a higher bid through our payment provider. No account, login, or registration is required or offered.

    Eligibility

    You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal authority to use the payment method you provide. By placing a bid, you confirm both.

    How bidding works

    • A square belongs to whoever placed the highest confirmed bid, for as long as no one outbids them — there is no expiry.
    • To take an already-claimed square, your bid must exceed the current bid by at least $1 (or the minimum increment shown at checkout).
    • Payments are captured immediately and are final and non-refundable — including if another bid is confirmed for the same square moments before yours. This can happen when two people complete payment for the same square at nearly the same time; only the bid our system confirms first keeps the square.
    • Ownership of a square is proven solely by a secret link generated after payment. There is no account recovery: if you lose that link, we have no way to verify or restore your ownership.

    Payments

    Payments are processed by Polar, acting as merchant of record, in EUR. We do not collect or store your card details. Your relationship with Polar for payment processing is also governed by Polar's own terms.

    What you submit

    When you bid, you provide a destination URL and, optionally, a GitHub handle. Your square will publicly display an image (your site's favicon or your GitHub avatar) and link out to the URL you provided. You are solely responsible for the content of the site you link to and for having the right to link to it and display its favicon or avatar.

    Prohibited content

    You may not link to sites that:

    • are illegal, fraudulent, or facilitate phishing or malware distribution;
    • infringe someone else's intellectual property or impersonate a person or brand;
    • contain content that is hateful, harassing, or sexually exploitative of minors;
    • violate any applicable law in your jurisdiction or ours.

    We may remove any square, at our sole discretion and without notice or refund, if we believe it violates these rules or otherwise harms the service or its visitors.

    No warranty

    The service is provided "as is", without warranties of any kind. We do not guarantee uninterrupted availability, that a specific square will remain unclaimed while you complete checkout, or that third-party services we rely on (payments, hosting, image resolution) will always work.

    Limitation of liability

    To the maximum extent permitted by law, DesignWall is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including a payment made for a bid that lost a race condition as described above.

    Governing law

    These Terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the courts of [YOUR JURISDICTION], except where mandatory consumer-protection law in your country of residence gives you the right to bring a claim elsewhere.

    Severability

    If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.

    Changes

    We may update these Terms from time to time. Continued use of the service after a change means you accept the updated Terms.
